The study
of the modern State in the West is the most important thing to understand life,
since, it is born in a well-founded and organized society that has had to
conform in some way or another to be able to coexist. In the present case, we
were born in a state named the United States Mexican, constituted by federal
republic, representative, democratic and lay, commonly it is only called Mexico.
However, this being represents the most problem in the life of the Mexican nation
and it cannot be in another way because of the various and complicated interests
of all type: sociological, cultural, class, juridical, political, economic and
other nature. Notwithstanding the previous, the present book will introduce to
the public power, its organic and institutional structure and it will proffer analyse
the transition of the modern state to the hipper modern state. The book will be
divided in two parts. The first is designated to the expository study of the
modern state, the second will have a destructive part, negative, but at the
same time it will propose a new state structure and its respective terminology.
The modern state has its own characteristics and it adopted the theory of the
"division of powers" of Charles-Louis de Secondat, Baron de La Brede
et de Montesquieu, generally referred to as simply Montesquieu. His book bears
a title even more extensive than of its author: "Of the spirit of the laws
or of the relation that the laws must have with the Constitution of each
government, the customs, the climate, the religion and the commerce..."
And that gives a clear idea of the teleology of the book. The book is
impressive by its harmonic and deep structure in its most important part. Twenty
years of work. In spite of it, his theory of the "Division of the
powers" bears printed a fatal mistake, confuse "power" with
"organ". This problem, apparently insignificant and just thing of
linguistic terms, in reality it is translated in an ontological problem (what
exists and its relations whit the existent) that carries with it serious
consequences to the people. We do not advance the subject and when the point
has arrived, you will see what I am talking about. Now well, the modern state
began to dismantle itself at the beginning of the decade of 1980 with the start
of the privatization of the public goods. There was not reverse. The Free Trade
Agreements formalized the termination of the modern state, it was signed in
1992 and it entered into force in January 1st, 1994. This resulted
in the gradual abandonment of the state model with a juridical system of
rectory of the economy, and a legal system of a private and individualistic
nature was adopted.
A minimum
state, guardian of private property, arbitrator of adverse interests. The year
1989 was crucial for the triumph of Neoliberalism and that was the beginning of
the fall of the socialist bloc headed by The Union of Soviet Socialist
Republics (USSR). Without any competition the neoliberalism launched itself to
conquer the world market, imposing deregulations on weak national states to
resist harassment and it was knocking down barriers of all type and it launched
the west world to a super production and a hyper consume than only favours
transnational corporations.
